Old Packhouse Market Project
1. Purpose
These Terms and Conditions outline how donations made in support of the Old Packhouse Market (OPM) project are received, held, and applied. By making a donation, you acknowledge and agree to these Terms and Conditions.
2. Receiving Organisation
All donations are received and administered by the Far North Resilient Communities Charitable Trust, a registered New Zealand charitable trust operating exclusively for charitable purposes.
The Trust is governed by an experienced board of trustees and is accountable under the Charities Act 2005.
3. Use and Management of Donations
- Donations made for the Old Packhouse Market project are held in a dedicated bank account.
- Funds are applied only in furtherance of the Trust’s charitable purposes and, where specified, to activities directly related to the OPM project.
- The trustees retain responsibility for the proper application of funds and exercise their discretion in good faith and in accordance with the Trust Deed and applicable law.
- The Trust is committed to transparency, sound financial management, and responsible stewardship of all donations.
4. Fundraising Risk and Project Viability
The Trust is confident in the viability of the Old Packhouse Market project and is actively working toward securing the required funding and completing the purchase.
However, community-led fundraising initiatives carry inherent uncertainty, and there remains a possibility that the full funding required may not be achieved within the required timeframe.
5. If the Project Does Not Proceed
If the Old Packhouse Market purchase does not proceed, the following arrangements will apply:
a. Donations of $1,000 or less
Donations of up to $1,000 will be applied to another community resilience initiative administered by the Trust that aligns with its charitable purposes.
b. Donations over $1,000
For donations exceeding $1,000, where the donor has provided contact details, the Trust will contact the donor to discuss appropriate options. These may include:
- reallocation of the donation to another agreed Trust project
- a refund, where appropriate
- or a combination of refund and retention of a reasonable portion to cover legitimate administrative and project costs already incurred
Any such discussions will be undertaken in good faith.
6. Nature of Donations
All donations are made as voluntary charitable gifts.
Donations do not confer any ownership interest, financial return, governance rights, or decision-making authority in relation to the Old Packhouse Market project, property, or associated entities.
7. Privacy and Personal Information
The Trust collects and uses personal information in accordance with the Privacy Act 2020.
Donor information is used solely for legitimate purposes, including:
- issuing donation receipts
- providing project updates where consent has been given
- contacting donors where necessary in relation to their donation
The Trust does not sell, trade, or disclose donor information to third parties except where required by law.
8. Tax Receipts
Donations of $10 or more qualify for a New Zealand charitable donation receipt. Receipts will be issued in accordance with Inland Revenue requirements.
9. Amendments
The Trust reserves the right to amend these Terms and Conditions from time to time to reflect operational, legal, or regulatory changes. The version published on this website at the time a donation is made will apply.
